#1: Post election outlook for employment law

The 2019 Australian federal election is imminent and the major parties have different visions for the future of industrial relations. We consider the proposals and their possible implications:

ALP proposals

  • Changes to the National Employment Standards (NES): leave entitlements, superannuation, flexible working
  • Changes to employment classifications: tests for for status determinations and casual employment, Auditing use of independent contractors
  • Changes to occupational health & safety: workplace deaths
  • Changes within industrial relations: Industry-wide enterprise bargaining, protections for EAs, good faith bargaining and working conditions for labour hire workers

Coalition proposals

  • Employee focussed changes:
    • Skilling Australians Fund (a scheme funded by employers who sponsor migrants)
    • Youth Jobs PaTH scheme, which provides employers a financial incentive to hire 17-24 year olds
    • Women’s Economic Security Statement, which promotes female participation in the workforce
  • Action by regulatory bodies:
    • Registered Organisations Commission
    • Reviving the Australian Building and Construction Commission
