A partner based in our London office, Rachel qualified in England and Wales in 1998 and advises on all aspects of employers’, motor, product and public liability claims, with particular technical expertise in the handling of high value technical and catastrophic injury cases, and a specialism in traumatic brain injury.

Rachel has extensive experience of rehabilitation management, effective use of ADR and provisional damage awards, and the setting up and management of periodical payment regimes. She is a trusted advisor to multinationals and high net worth clients both directly and through insurers because of her experience in managing high-profile cases, brand and media management. She advised on the matter of Kotula v EDF Energy Networks (EPN) plc & Others [2010, 2011], resulting in two reported High Court decisions on contributory negligence and guidance on the extent of the court's power to award provisional damages and permit the variation of periodical payments.

Rachel has significant experience in managing claims arising from accidents abroad, international litigation and jurisdiction disputes, utilising Kennedys’ extensive overseas offices. She co-authors the jurisdiction and applicable law chapter in the Kennedys’ Claims Handling Law and Practice Guide, the latest edition was published in February 2021, and has written extensive articles and presented client webinars on handling claims with an overseas element. She represented the successful defendant in the leading case on extending time for service out of the jurisdiction Al-Zahra (PVT) Hospital & Ors v DDM (2019).

Rachel has extensive trial experience both in relation to catastrophic injury claims and associated coverage issues. Notable cases include Humphrey v Aegis Defence Services Ltd and Aegis Defence Services (BVI) Ltd [2014] and [2015] Court of Appeal, where she successfully defended a claim relating to training exercise in Iraq and the first reported case where s.1 Compensation Act was applied. In Komives & Anor v Hick Lane Bedding Ltd & Anor (2021) where the Court of Appeal upheld that an insurer was entitled to avoid an employer’s liability policy when the employer had been involved in “modern slavery”.

Work highlights

  • Managing a number of over £1m spinal injury and psychiatric injury claims relating to training exercises in Iraq including four successfully defended (two at Court of Appeal).
  • Settled a £3m fatal accident claim following contact with an overhead cable. This was a highly sensitive and required press management.
  • Successfully defended jurisdiction in head injury case following a road traffic accident in Dubai; managed related policy coverage issues.
  • Settled a £1.5m workplace stress claim on terms that reduced the risk of similar claims from co-workers.
  • Managed a £15m T6 paraplegic road traffic accident case including provisional damages and periodical payments and managed annual payment calculations.
