Samantha is an Associate based in Kennedys’ Singapore office. She was admitted as an Advocate and Solicitor of the Supreme Court of Singapore in 2017.

Samantha practices commercial litigation and arbitration, with a focus on shipping and admiralty, marine insurance and trade disputes.

Samantha has advised and represented Protection & Indemnity Clubs, insurers, shipowners, charterers and commodities traders in cargo claims, charterparty disputes and other advisory matters. In addition, she has also advised creditors in insolvency proceedings.

Samantha has experience in civil commercial litigation and international arbitration under various arbitral institutions (e.g. SIAC, LMAA, ICC, CIETAC etc).

Work highlights

  • Diablo Fortune Inc v Cameron Lindsay Duncan and another [2018] SGCA 26 - Assisted in a landmark case before the Singapore Court of Appeal where the Court was invited to consider the juridical nature of a contractual lien on sub-freights. To reconcile the differing views of insolvency and shipping practitioners on this point, this case was raised in Parliament which then spurred legislators to propose amendments to the Companies Act to exempt such liens from the requirement of registration under section 131.
  • Assisted in CIETAC arbitration proceedings in Beijing, involving a dispute over several shipments of steel sold by the Chinese state-owned company to a Spanish steel company
  • Assisted in SIAC arbitration. proceedings against an Indonesian-based trading company involving a multi-million dollar dispute over the sale and purchase of nickel hydroxide.
  • Assisted a Chinese bank in arresting a vessel for a claim brought in respect of a mortgage on the vessel in the sum in excess of USD 14 million.
