Trevor Davies

Trevor is a London-based Partner and member of Kennedys’ Strategy Board. Qualifying in England and Wales in 1980, Trevor was the co-founder and senior partner of a boutique insurance law firm, which merged with Kennedys in 2008.

Trevor advises on a variety of insurance and reinsurance claims, policy drafting and coverage disputes. He specialises in advising on coverage and directly handles significant losses in the UK and abroad including large and complex property, casualty, product liability, product recalls and contingency risk claims.

Drawing on his particular expertise in medical device and pharmaceutical litigation, Trevor is currently representing manufacturers in some of the largest, most high-profile group claims in the UK and EMEA. These claims involve a variety of products such as metal on metal hips and pelvic mesh, including claims arising from one of the largest voluntary global recalls of its kind.

Trevor has represented the insurance market in numerous significant losses such as the Glasgow School of Art fire (2018),  a US$100m explosion at a power station in Jamaica, the 2008 Channel Tunnel fire, and substantial claims arising from allegedly defective ship propulsion units.

He has also handled various multi-million pound product claims involving alleged benzene contamination of carbonated drinks, international pharmaceutical drug recalls and group claims against manufacturers of prostheses.

Trevor is a regular industry speaker on topics ranging from general coverage issues and product liability to large property losses and business interruption. He is the only solicitor member of the Fellowship Vetting Committee of the Academy of Experts. He is also a member of the Forum of Insurance Lawyers (FOIL).

Work highlights

  • Wilkes v DePuy International Ltd [2016]. Successfully defended an international manufacturer in a landmark product liability High Court ruling, in relation to a defective hip prosthetic, which clarified the correct formulation of defect under the Consumer Protection Act 1987.
  • Allen and others v Depuy International Ltd [2014]. Representing manufacturers of hip replacement products subject to a worldwide voluntary recall in August 2010, involving 93,000 patients. This is one of the largest recalls of its kind and Trevor is handling all UK claims directly as lead lawyer, and managing all claims in Europe, the Middle East and Africa.
  • Representing manufacturers of gynaecological products not subject to product recall. Multi district litigation is underway in the US involving tens of thousands of plaintiffs. We are handling all UK claims directly and acting as lead lawyers managing all claims arising in Europe, Middle East and Africa.
  • Acted for the excess market in respect of substantial first party property claims arising from the Channel Tunnel fire in September 2008, which gave rise to coverage litigation in both London and Paris.
  • ACE European Group Ltd and others v Rolls-Royce PLC [2010]. Successfully acted for excess insurers – issues involving jurisdiction and forum non conveniens – in coverage action arising from very substantial product liability claims (Mermaid Pod ship propulsion units).
  • Tesco Stores Ltd v David Constable (and all other members of syndicate 386) and others [2008]. Successfully defended public liability insurers in respect of multi-million pound losses arising from the Gerrards Cross tunnel collapse.
  • Outokumpu Stainless Ltd v AXA Global Risks (UK) Ltd and others [2007]. Successfully represented defendant insurance market in a High Court case regarding an insurance coverage dispute arising from a multi-million pound radioactive contamination claim.
