Medicolegal expert training

A bespoke learning course for prospective and established medicolegal expert witnesses.

This one-day training session, delivered by specialist clinical negligence lawyers and a Deputy High Court Judge, is targeted towards:

  • Clinicians interested in commencing medicolegal work as part of their practice.
  • Medicolegal experts wishing to improve or refresh their knowledge and skill.

The training will consist of the following sessions:

Session 1: Foundations and Development of Clinical Negligence  Law | 180 minutes

  • Understanding Medicolegal Principles: Duty of Care, Breach of Duty of Care, Causation and Damages.
  • Key Legal Tests: Bolam, Bolitho, Montgomery, McCulloch, res ipsa, but for, material contribution.
  • Duty to the Court Vs. duty to the client, responsibilities, professional boundaries, ethical challenges and conflicts of interest. 

Session 2: The Expert Report — Crafting a Bullet Proof Opinion | 90 minutes

  • Core structural components, credentials, declaration of independence, CPR Part 35 duties and correct application of legal tests

Session 3: The Art of Defending your Opinion — Courtroom & Conference Skills | 60 minutes

  • Led by Leading Counsel and Deputy High Court Judge, Charles Bagot KC.
  • Anticipate and prepare for cross examination and challenge.
  • View from the bench - what makes a good or bad expert?
