This one-day training session, delivered by specialist clinical negligence lawyers and a Deputy High Court Judge, is targeted towards:
- Clinicians interested in commencing medicolegal work as part of their practice.
- Medicolegal experts wishing to improve or refresh their knowledge and skill.
The training will consist of the following sessions:
Session 1: Foundations and Development of Clinical Negligence Law | 180 minutes
- Understanding Medicolegal Principles: Duty of Care, Breach of Duty of Care, Causation and Damages.
- Key Legal Tests: Bolam, Bolitho, Montgomery, McCulloch, res ipsa, but for, material contribution.
- Duty to the Court Vs. duty to the client, responsibilities, professional boundaries, ethical challenges and conflicts of interest.
Session 2: The Expert Report — Crafting a Bullet Proof Opinion | 90 minutes
- Core structural components, credentials, declaration of independence, CPR Part 35 duties and correct application of legal tests
Session 3: The Art of Defending your Opinion — Courtroom & Conference Skills | 60 minutes
- Led by Leading Counsel and Deputy High Court Judge, Charles Bagot KC.
- Anticipate and prepare for cross examination and challenge.
