International arbitration and mining in Africa: the best dispute forum in 2026?

The use and scope of international arbitration continues to grow in Africa, as evidenced by the significant increase in the number of disputes in recent years.


This is notable in relation to minerals, with Africa holding around 30% of the world’s critical mineral reserves. In 2025, some of the largest mining projects in the world finally got off the ground and other major projects were given the green light. Yet meanwhile countless exploration and exploitation licences were cancelled across the continent as states consider their policies in relation to their natural resources.


The knock-on effects of any changes in policy can be wide-reaching, touching insurance issues, infrastructure, transport or security, and encompassing both investment and commercial disputes. Is arbitration the ideal forum for resolving disputes across the continent? Does it bring concrete results? And what kinds of arbitration should be preferred?
