Evolve with Kennedys

We are delighted to bring back our bite-size webinar series as part of the Evolve with Kennedys programme, where our experts will be providing short "wrap up" sessions on key cases that Kennedys has been involved in over the years. 

During this webinar Christopher Butler and Caitlin Gallagher will be discussing the matter of Kew Holdings Limited v Donald Insall Associates Limited, where they acted in the successful defence and ultimate strike out of the claimant’s claim. The matter concerned a range of issues related to adjudication enforcement, security for costs and cross border dispute resolution.

Following an earlier successful adjudication against Kew Holdings, Kennedys sought to enforce the adjudicator’s decision on behalf of Donald Insall. The claimant issued a separate claim against Donald Insall with the apparent desire to avoid payment of the adjudication enforcement. Kennedys successfully resisted the claim.
