The recent decision of Justice Beach in Robertson v Singtel Optus Pty Ltd [2023] FCA 1392 rejected a claim of legal professional privilege over a forensic investigation report prepared by Deloitte into Optus’s September 2022 data breach.

This webinar looks at the case and its implications for Australian entities responding to a cyber incident. The decision provides lessons about the challenges of establishing legal professional privilege in a forensic investigation report, what conduct is inconsistent with legal professional privilege, and the importance of getting lawyers involved in the cyber incident response process early.
