Dougal is a Special Counsel in Kennedy’s Sydney office. Dougal has over 20 years’ experience in insurance and commercial litigation, with a focus on financial lines and professional indemnity coverage and defence.

Dougal has conducted a wide range of matters in Federal and State jurisdictions and has particular experience in professional indemnity matters raising issues of fraud and dishonesty. He regularly advises insurers at all levels of cover in relation to major Australian and overseas litigation and has also provided advice on aspects of commercial and competition law.

Work highlights

  • Defending a wide range of professional negligence claims against legal practitioners, including matters arising from commercial and property transactions, intellectual property disputes, conduct of litigation, wills and estates disputes, conveyancing, insolvency and employment law issues.
  • Defending claims against other professionals including accountants, insolvency practitioners, architects and other professionals.
  • Providing coverage and monitoring advice to insurers in relation to class action litigation in Australia and overseas.
  • Acting in prominent Australian coverage proceedings, including a successful appeal, on behalf of insurers of a large multinational construction group.
  • Advising primary and excess layer insurers in relation to major claims against financial institutions, listed entities and professional service firms.
  • Acting in disputes involving loan fraud, identity fraud, misuse of trust moneys and trust property.
  • Providing advice in relation to defamation matters in a range of contexts, including claims against professional service providers, board disputes, disputes involving government, educational and religious organisations and liaison between insurers and policyholders regarding defamation actions and threats.
