Webster is an Associate in Kennedys’ Melbourne office and Australian Healthcare team. Webster acts for a variety of clients, predominantly acting for clients in civil litigation proceedings in the County and Supreme Court of Victoria. Webster also assists clients in disciplinary proceedings before AHPRA, as well as proceedings in the Coroners Court of Victoria.

Webster has five years of experience in medical negligence having been Associate to the Judge who managed the Medical List at the County Court of Victoria and then in defence litigation. Prior to joining the team at Kennedys, Webster worked on a wide range of medical negligence matters with both public and private clients and advising on the risks and merits of defending claims.

Work highlights

  • Acting for an Orthopaedic Surgeon in a multi-party proceeding concerning complex spinal surgery. We were able to reach a settlement where there was an expedited timetable with a reduced contribution from the client.
  • Assisting two radiation oncologists in a claim involving the treatment of anal squamous cell carcinoma. This was a high value claim with an expedited timetable in which we were able to reach a resolution and negotiation a heavily reduced contribution for the clients.
  • Acting for the insurer in a medical negligence claim where the member had passed away and the insurer was named as a defendant by way of the Insurance Contracts Act 1984 (Cth). We were able to advise the client in relation to the operation of the Insurance Contracts Act 1984 (Cth) and how it applied in this particular matter.
