Kennedys prevails in prerogative writ land use trial in Sussex County, New Jersey

Anand Dash secured a landmark victory in State Superior Court involving Kennedys’ representation of a municipal government client.  
 
Anand successfully defended a Township’s land use ordinance no. 26-05 from a challenge filed by a developer to the validity and constitutionality of the ordinance.  Anand argued that land use ordinances, such as ordinance 25-06, should adapt to the evolving needs of a community and should not be limited by an outdated vision in a municipality’s Master Plan.  Anand persuaded the Court that municipalities can pass land use laws that are inconsistent with the Master Plan, provided that, they have a rational basis, meet all statutory criteria, are supported by evidence and are reasonable under the circumstances.
