Mickey Schneider, Kristen Barone and Jeremy Perillo obtained a defense verdict in Kings County, New York involving a construction site Labor Law claim.
The construction site accident was initially reported on day one as a finger laceration. However, the following day the plaintiff went to a different hospital and claimed that he fell 14 feet from a ladder in an attempt to trigger liability under Labor Law 240(1). We argued that the credible evidence supports only one conclusion that plaintiff did not fall from a height.
The jury returned the verdict in less than a half hour of deliberations.
