Jose María is a Partner and co-founder of Kennedys’ Madrid office. He qualified in Spain in 1990 and is fluent in English.

He has extensive expertise in insurance and reinsurance matters. He specialises in procedural law, with more than 25 years’ experience in defence work and coverage litigation both locally and internationally. He is a skilled litigator and frequently appears before the Spanish courts at first instance and appeal hearings. In addition to representing insurers in civil cases, he also protects insurers’ interests in the criminal courts when a claim for civil liability is included in criminal proceedings.

Jose María’s practice is particularly focused on construction, property and professional liability. He is also frequently involved in energy and general liability claims. He is an accomplished negotiator and has reached favourable out of court settlements on countless occasions. Jose María also serves as an overseer for matters in Spain and Latin America.

He has written numerous articles on insurance law and contributes to Kennedys’ publications on a regular basis.

Work highlights

  • Defended the interests of the insurer of an important manufacturer and distributor of industrial gases in a lawsuit brought against its upper management. While unloading a truck of toxic material, an explosion occurred resulting in the death of the driver and significant damage to the industrial site. A preliminary judgement was issued absolving our client’s insured.
  • Represented architects in a project where they served as project and works management for the construction of a transportation hub in the Canary Islands. The roof of the hub collapsed due to inclement weather and civil claims were brought.
  • Intervened on behalf of insurers facing claims from occupants and third parties who suffered losses as a result of the collapse of an important building in Madrid. An out of court settlement was reached for €13 million.
    Represented the occupant’s insurer after a large industrial warehouse in Madrid was destroyed by fire. A judgment was issued ordering the owners to pay €42 million.
  • Defended a multinational cable manufacturer against a possible lawsuit by an electric company for €30 million after a fire in an electrical plant, which was settled for €2.2 million.
  • Defended a lawsuit brought by the owners of a gas plant under construction that suffered damage as the result of a fire. The lawsuit was filed for €60 million and was settled out of court for €9 million.
