John Farrell

John is a partner in our London office. He qualified in England and Wales in 1993, and specialises in the areas of construction and engineering, insurance/reinsurance, product liability, professional indemnity and media liability. He also sits on the firm’s ‘Emerging Risks’ strategy group.

John acts for civil engineering contractors and consultants, engineering manufacturers. Employers, public authorities as well as some of the markets largest and international (re)insurers.

He has particular experience in claims relating to contractors’ all risks (CAR) and significant expertise in alternative dispute resolution including early neutral evaluation and mediation.

John has advised on a number of high value and complex claims, from a £28 million dispute in relation to the design of various works on 34km of highway to advising adjusters and insures on the application of CPA conditions.

The Gracechurch London Market Insurance Law Report 2016 describes John as “Excellent advice on a construction claim. Keeps me advised about all developments. Rates are reasonable.”

John is a member of the Forum of Insurance Lawyers, and regularly contributes to Kennedys’ internal publications.

Work highlights

Acted for a consulting engineer in a £28m dispute brought by the contractor in respect of the design of various works on 34 km of highway.

Acted for Canary Wharf Group and their insurers in respect of various claims arising under the project policy.

Advising adjusters and insurers on the application of CPA conditions in hired plant claims.

Acted for CAR and project insurers and re-insurers in a series of claims involving flood and/or water damage caused by defective design and/or workmanship in water service and then advising on subrogated proceedings.

Acting for a contractor and their insurers in respect of a £10m dispute arising from the construction of a floor slab.

Acted for product liability insurers in a claim relating to the use of a proprietary product used in Formwork on the largest infrastructure project in London.

Acting for insurers and public authorities defending defamation claims.

Acting for CAR insurers in respect of claims arising from a defective product incorporated into a light rail system and advising on subrogation proceedings against the supplier/manufacturer.
