Tyler is an Associate in the Employment law team in Melbourne.

Tyler acts predominantly for large ASX-listed companies, small-to-medium enterprises, State, Federal and Territory governments, local councils and public-owned entities in a variety of complex employment matters.

Prior to joining Kennedys, Tyler worked for mid-tier and a boutique law firm in their employment law teams, where he acted in a range of employment law matters, including unlawful terminations, adverse action, unlawful discrimination, award/enterprise agreement interpretation, employment/independent contracts, restraint of trade, underpayment of wages, workplace investigations, grievances, whistle-blower claims, and workplace bullying. Tyler has significant experience acting and appearing in the Fair Work Commission, the Federal Circuit and Family Court of Australia, and the Federal Court of Australia.

Tyler enjoys working closely with clients to resolve issues in a practical and pragmatic manner and is uniquely placed to understand employers' commercial interests, having worked in-house as an employee relations practitioner at Australasia’s largest retail fashion group and one of the world's largest land transport companies.

Work highlights

  • Acting for and defending a corporation against a general protections claim made by a former employee in the Federal Circuit and Family Court of Australia, with a favourable commercial settlement being agreed to by the parties prior to judgement.
  • Advising a client on a complex and sensitive investigation involving allegations of sexual harassment and bullying against a senior executive, with favourable separation terms being successfully negotiated with the senior executive upon completion of the investigation.
  • Advising and acting for a national transport regulator in the Magistrates’ Court of Victoria in pursuing a prosecution arising from workplace fatalities.
  • Acting on behalf of an employee in a significant underpayment claim against a consulate in the Federal Court of Australia involving complex issues, including international service in line with the Hague Service Convention and bilateral treaties, the incorporation of a Department of Foreign Affairs and Trade enterprise agreement into an employment contract, and urgent interlocutory applications being sought against the Respondent on the basis of non-compliance with court orders.
  • Achieving a significant settlement for an employee in a longstanding and highly disputed sexual harassment claim in the Australian Human Rights Commission and the Federal Court of Australia.
  • Assisting one of Australasia’s largest retail fashion groups in establishing a stand-alone employee relations team, including preparing policies, processes, procedures, and contracts of employment.
